On 03.11.2023 the learned counsel for the appellants had stated that he had written registered letters to the appellants but no response was received from them and accordingly, notices were issued to the appellants and the respondent. As per the office report, appellant No.1 stands duly served. However, none has put in appearance on his behalf despite service. Appellant Nos.2 and 3 are reported to have died. None has come forward to be impleaded as legal representative of appellant Nos.2 and 3. Legal representatives of the sole respondent also stand duly served. However, no one has put in appearance on their behalf also. 2.

Today learned counsel for the appellants has again stated that he still has no instructions in the matter.

In view of the above, this Court is left with no other option but to dismiss the present appeal for non-prosecution. 4.

Dismissed for non-prosecution with liberty to revive in case anything survives in the matter. Pending applications, if any, also stand disposed off.
