Ramendra Jain, J (Oral) Through the instant petition under Section 438 Cr.P.C., prayer has been made for grant of anticipatory bail to the petitioner in case FIR No.64 dated 03.03.2019 under Section 61/1 of the Punjab Excise Act, 1914 registered at Police Station, Phillaur, District Jalandhar. According to the prosecution, on 03.03.2019 on the basis of a secret information, the police conducted a raid at the disclosed place and recovered 10 boxes of illicit liquor.

CRM No.M-12317 of 2019 [2] Learned counsel for the petitioner contends that the premises from where alleged liquor was recovered does not belong to the petitioner. He has falsely been implicated. No recovery has to be effected from him. On the other hand, learned State counsel refuting the aforesaid submissions, contends that room from where illicit liquor was recovered is not a tenanted premises of the petitioner, rather it is owned by him.
Having heard learned counsel for the parties and considering the fact that since the recovery of 10 boxes of liquor has been effected from the owned property of the petitioner, this Court is not inclined to grant the concession of anticipatory bail.
The petition is dismissed.
