(ORAL) 1.

The instant petition has been filed under Section 438 Cr.P.C., seeking the indulgence of anticipatory bail to the petitioner. 2.

In FIR bearing No. 0031 of 11.2.2022, registered at Police Station Civil Lines, District Batala, offences constituted under Sections 326, 341, 323, 427, 506, 120-B, 148, 149 IPC, are embodied. 3.

The learned State counsel, on instructions given to him by ASI Sukhraj Singh, submits, that the petitioner has joined the investigations, and, that all the relevant recoveries, have been effectuated, by the present petitioner, to the investigating officer concerned. He further submits, that the condition of the victim-complainant, is stable, both in respect of his mental, and, physical condition.

Given the above, and, also when no evidence is adduced before this Court by the prosecution, suggestive of the fact, that in the event of the petitioner, becoming admitted to anticipatory bail, there is every likelihood of GURPREET SINGH 2022.05.24 17:59 I attest to the accuracy and authenticity of this document Chandigarh

CRM-M No. 15006 of 2022 -2his fleeing from justice, and, tampering with the prosecution evidence. Therefore, this Court does not deem it fit, and, appropriate to order for the custodial interrogation of the petitioner, as it would unnecessarily fetter, and, curtail his personal liberty.

Consequently, the instant petition is allowed, and, the order made by this Court on 8.4.2022, is made absolute on the same terms and conditions.

The afore observations are meant only for the disposal of the present petition, and, shall not affect the merits of the trial arising from the FIR (supra).
