By filing this petition under Section 340 read with Section 482 of Code of Criminal Procedure, the petitioner seeks initiation of criminal proceedings under Sections 193 and 211 IPC against the respondent.

It is contended by the learned counsel for the petitioner that respondent, Jaspreet Kaur had filed one Transfer Application No. 528 of 2015 which was decided vide order dated 15.02.2016 (Annexure P-3). In the said transfer application, the respondent misled this Court by wrongly stating before the Court that her financial condition was not sound. It is further contended that the respondent concealed the factum of her government job at Rupnagar. Therefore, it is submitted that necessary action be initiated against the respondent for misleading the Court.

I have heard the learned counsel for the petitioner and have gone through the case file.

CRM-M-23603 of 2016 (2) In the order dated 15.02.2016 passed by this Court, it is observed that the respondent was working at Rupnagar, therefore, the request to transfer proceedings from Ludhiana to Ropar was declined. In other words, the contention/pleading framed by the respondent was not accepted by this Court. This Court feels that it is not expedient to initiate proceeding against the respondent under Section 340 Cr.P.C. Consequently, the petition is dismissed.
