(ORAL) The present regular second appeal has been preferred by the appellant/plaintiff against the judgment and decree dated 16.03.1994 passed by the Sub Judge Ist Class, Patiala, whereby the suit for declaration and permanent injunction filed by the appellant/plaintiff has been dismissed, as well as, the judgment and decree dated 23.01.1995 passed by the Additional District Judge, Patiala, whereby the appeal filed by the appellant/plaintiff has also been dismissed. There is no representation on behalf of the appellant despite the counsel having been informed about the pendency of the case, at least thrice. In view of the above, it appears that the appellant is not interested in pursuing the case.

Dismissed as not pressed.
