Both the above-mentioned cases are taken up together as the same have arisen from same FIR.

Petitioners have filed these petitions under Section 438 Cr.P.C.

CRM No.M-23692 of 2018 and connected petition -2for grant of anticipatory bail in case FIR No.54 dated 23.03.2018 under Section 420 IPC, registered at Police Station City Moga. Notice of motion was issued. Learned State counsel appeared and contested the petitions.

I have heard learned counsel for the petitioners as well as learned State counsel and have gone through the record. From the record, I find that FIR in the present case has been registered on the basis of written application given by Askhit Jain, Mayor, Municipal Corporation, Moga. As per the FIR, on 22.03.2018, complainant conducted sudden raid in the Library and caught chowkidar Gurpreet Singh of Sewa Kendra red handed, who was receiving `5,000/- from NRI Harmanpreet Singh. From the accused, one letter pad of Prabha Hospital having verification and certification of concerned doctor, was recovered. When he was interrogated, he admitted that Davinder is running Aadhaar Card Centre and his assistant Pardeep Kaur is also involved with him. Complainant got arrested all the accused persons.

Prabha Hospital also made a private complaint, in which it was requested that action be taken against the accused persons and to hold an enquiry. It is further stated that false Aadhaar Cards were got prepared on the basis of false documents. Keeping in view the serious allegations against the petitioners, no ground is made out for grant of anticipatory bail. Aadhaar Card is an identity document issued by Government of India to its citizens and these persons were issuing Aadhaar Cards on the basis of false documents, which is a serious matter. Both the petitioners are named in the FIR. Petitioner Pardeep Kaur is also helper of Davinder Singh.

CRM No.M-23692 of 2018 and connected petition -3dismissed.

However, nothing stated above, shall constitute my opinion on merits of the case.
