CORAM:

HON'BLE MR. JUSTICE INDERJIT SINGH

Present:

Mr.Randeep Singh, Advocate for Mr.Vipin Mahajan, Advocate for the petitioners.

Mr.Karanbir Singh, AAG, Punjab for the respondent-State.

Mr.Bikramjit Singh Randhawa, Advocate for the complainant.

**** INDERJIT SINGH, J.

Petitioners have filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.117 dated 07.12.2017 under Sections 326, 324, 323, 506, 148 and 149 IPC, registered at Police Station Batala, District Gurdaspur.

Notice of motion was issued. Learned State counsel as well as learned counsel for the complainant appeared and contested the petition. I have heard learned counsel for the parties as well as learned State counsel and have gone through the record. As per prosecution version, petitioner Gurnam Singh was VINEET GULATI 2018.08.17 12:24 I attest to the accuracy and authenticity of this document Chandigarh armed with kirpan and he gave injury on the left knee of the complainant,

CRM No.M-23697 of 2018 -2which has been declared grievous. Similarly, Malkit @ Malkeet Singh was stated to be armed with datar and he gave injury on the left wrist of the complainant.

Keeping in view the facts and circumstances of the present case and attribution to the petitioners that they gave grievous injuries to the complainant and also in view of the fact that weapons are still to be recovered, I find that petitioners are required for custodial interrogation and no ground is made out for grant of anticipatory bail to them. Therefore, finding no merit in the present petition, the same is dismissed.

The order dated 30.05.2018 granting interim bail to the petitioners stands vacated.
