Prayer made in the present petition is for directing the respondents to promote the petitioner retrospectively from the date 14.08.1997, when his junior was promoted and quashing the impugned orders dated 27.08.2003. 2.

Learned State counsel refers to para 4 of the replication dated 01.08.2008 to state that since the petitioner did not submit the case for promotion to the said post upto cut of date i.e. 23.06.1997, his claim was rightly rejected.

Disposed of, reserving the petitioner with a liberty to get it revived, in case lis still subsists.
