(ORAL) Present writ petition has been filed for directing respondent No.2 to decide the complaint dated 07.07.2023 (Annexure P-1) inspite of report submitted by SDM as per order passed by this Court, pending against Sarpanch, Gram Panchayat Panhera Kalan, Tehsil Ballabgarh, District Faridabad before Deputy Commissioner, Faridabad. It has been submitted by learned counsel for the petitioner that for the redressal of his grievance, the petitioner has already filed his representation/complaint dated 07.07.2023 before respondent No.2 but no action has been taken on the same till date.
Notice of motion to the official respondents at this stage. On asking of the Court, Ms. Upasna Dhawan, AAG, Haryana appears and accepts notice on behalf of the respondents-State. CWP No.6482 of 2024 -22024:PHHC:038271 submitted that the petitioner had earlier approached this Court as well by way of filing the petition bearing CWP No.509 of 2024 which was disposed of vide order dated 11.01.2024 with a direction to the Sub Divisional Magistrate, Ballabgarh to conclude the inquiry within six weeks. She has submitted that the inquiry as directed by this Court has already been completed and the same is sent to the Deputy Commissioner, Faridabad for taking further necessary action on the basis of the inquiry conducted. She has also apprised the Court that final decision would be taken by the Deputy Commissioner, Faridabad within a period of two months.
In view of the above position, the present petition is disposed of with a direction to respondent No.2 i.e. Deputy Commissioner, Faridabad to take the final decision on the inquiry conducted in accordance with law expeditiously preferably within a period of two months from the date of receipt of copy of this order.
