Present petition has been filed for conducting an enquiry under Section 340 read with Section 195 of the Code of Criminal Procedure, 1973 (for short, 'the Cr.P.C.') against respondent No.2 for securing an order dated 05.01.2023 from the Coordinate Bench on the basis of false affidavit dated 20.09.2022.

Contends that order dated 05.01.2023, passed by the Coordinate Bench in CRM-M-146-2023 was obtained by respondent No.2 on the basis of false affidavit.

Heard learned counsel for the petitioner and perused the paper-book.

After hearing learned counsel for the petitioner, this Court is not convinced that any false affidavit was filed by respondent No.2; ATUL SETHI 2024.05.08 17:36 I attest to the accuracy and integrity of this document -1-

CRM-M-19879-2023 nor there is any substance for initiating the proceedings under Section 340 Cr.P.C.

However, keeping in view the controversy involved, present petition is disposed off with the observation that learned Judicial Magistrate 1st Class, Panchkula shall not grant any unwarranted adjournment(s) to either of the parties. 6.
