Prayer in this petition is for grant of anticipatory bail to the petitioner in FIR No.102 dated 17.06.2016 under Sections 326/323/354/506/ 148/149 IPC registered at Police Station Sadar Tarn Taran, District Tarn Taran. It is submitted that the petitioner has been falsely implicated in this case whereas, the dispute is, in fact, regarding an electricity connection. As per the medical record, simple injuries have been received by the wife of the complainant. CRM No.M-23653 of 2016 [2] investigation pursuant to interim order dated 15.07.2016 passed by this Court. Therefore, this petition be allowed.
Learned counsel for the State, on instructions from ASI Dilbag Singh, submits that the petitioner has joined investigation and his custodial interrogation is not required. No recovery is to be effected from him. It is affirmed that the complainant's wife suffered simple injuries. The petitioner is not involved in any other criminal case.
There are no allegations on behalf of the State that the petitioner is likely to abscond or that he is likely to dissuade the witnesses from deposing true facts in the Court, if released on bail. Keeping in view the facts and circumstances as above but without commenting upon or expressing any opinion on the merits of the case, this petition is allowed. Consequently, order dated 15.07.2016 is made absolute. It is clarified that none of the observations made hereinabove shall be construed to be a reflection on the merits of the case. The same are solely confined for the purpose of decision of the present petition. ( LISA GILL ) May 18 , 2017.
