Petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.206 dated 21.02.2019 under Sections 406, 420 and 120-B IPC, registered at Police Station City Jagadhri, District Yamunanagar.
Notice of motion was issued. Learned State counsel as well as learned counsel for the complainant appeared and contested the petition. I have heard learned counsel for the parties as well as learned State counsel and have gone through the record. From the record, I find that FIR in the present case has been got VINEET GULATI 2019.05.02 16:48 I attest to the accuracy and authenticity of this document Chandigarh registered by Darbari Lal Chauhan. As per the allegations, accused induced
CRM No.M-12290 of 2019 -2the complainant to give gold at cheaper rates. `5 lakhs was earlier paid to the accused and then again `5 lakhs was paid and accused further demanded more money etc. but the gold was not supplied. As per the FIR, a cheque has been given, which was also dishonoured.
Learned counsel for the petitioner contended that the petitioner has already got registered the DDR regarding theft of the cheque etc. The petitioner has already joined the investigation. He is not required for custodial interrogation. No useful purpose will be served by sending and keeping the petitioner in custody till the disposal of the case. Keeping in view the facts and circumstances of the case and without discussing the facts of the case in minute details and without expressing any opinion on the merits of the case, I find it a fit case, where the petitioner is entitled to benefit of anticipatory bail. Therefore, the present petition is accepted and the order dated 18.03.2019 granting interim bail to the petitioner, is made absolute.
