Prayer in this writ petition filed by the petitioner under Articles 226 of the Constitution of India, is for issuance of a writ in the nature of mandamus, certiorari or any other suitable writ direction or order quashing the decision of BOD of the respondent-Corporation taken in its 156th meeting held on 09.08.2002 (Annexure P-5), vide which the BOD has reiterated its earlier decision taken in its meeting held on 18.02.1999 (Annexure P-3)and its action in ordering respondent No.3 to look after the work of Sub Divisional Engineer inspite of being junior to the petitioner. Learned counsel for the petitioner submits that during the pendency of the present petition, the petitioner as well as the private respondent have retired from service, therefore, the instant petition has been rendered infructuous and the same may kindly be disposed of accordingly with liberty to the parties to revive the present petition, in case any cause still survives.
