(Oral) Prayer in this petition is for grant of regular bail to the petitioner, in a case arising out of FIR No. 06 dated 03.09.2015, registered at Women Police Station Faridabad, District Faridabad, who has been booked for having committed the offence punishable under Sections 376/452/506 IPC.
It is not disputed that before registration of the present F.I.R, there was a complaint made by the petitioner against the family members of the complainant for removal of encroachment of Gram Panchayat land. The revenue authorities even passed order (P-2 and P-3) for removal of the above said encroachment. Thereafter, the complaint was made by the prosecutrix to National Commission for Minorities and thereafter, the present F.I.R has been registered and as per report (P-8), an enquiry was conducted by SI Rajbir Singh and no truth was found in the complaint GAURAV ARORA 2016.08.01 11:19 I attest to the accuracy and integrity of this document

Learned State counsel on instructions from SI Ranbir Singh has informed the Court that out of 15 witnesses, 10 have been examined so far. Petitioner is in custody since 04.09.2015. Keeping in view the period of incarceration of the petitioner and the fact that the litigation was earlier pending between the parties, this court feels that there is no need to detain the petitioner any longer. Accordingly, the present petition is allowed.
