The present appeal pertains to the year 1995. Vide order dated 18.04.2024 fresh notice was issued to the appellants as well as the legal representatives of the deceased respondent No.1 as learned counsel for the appellants had pleaded no instructions in the matter. As per the Office report, the appellants and the legal representatives of the deceased respondent No.1 remain untraceable due to incomplete address. There is no other address available with the Court for effecting service on the appellants except the one mentioned in the memo of parties and in the judgments and decrees passed by both the Courts concerned and is the same on which the notice was sent.

Today again learned counsel appearing on behalf of the appellants pleads no instructions in the matter. In view thereof, this Court is AMAN JAIN 2024.09.30 09:30 I attest to the accuracy and integrity of this document

RSA-1364-1995 (O&M) -2left with no other option but to dismiss the present appeal for nonprosecution. 3.

Dismissed for non-prosecution with liberty to revive in case anything survives in the matter. Pending applications, if any, also stand disposed off.
