Mr. Naveen Sharma, Advocate for the petitioner. *** ANIL KSHETARPAL, J (Oral) The hearing of the case was held through video conferencing on account of restricted functioning of the Courts. This application has been filed by the wife with a prayer to transfer the petition, bearing No.HMA-22/2021 (Jaideep Grewal vs. Amandeep Kaur) filed under Section 9 of the Hindu Marriage Act, 1955, pending in the Court of Additional Civil Judge (Sr. Div.), Amloh, District Fatehgarh Sahib, to the Court of competent jurisdiction at Ludhiana. As per the office report, notice issued to the respondent has been served through his mother. However, he remains unrepresented. It is the case of the petitioner that she got married to respondent on 22.01.2012 and out of this wedlock, two children were born who are in her custody. She further claims that the respondent (husband) is already defending a petition under Section 12 of the Protection of Women from Domestic Violence Act, 2005. She further claims that the distance between the two cities is approximately 75 kms.

TA-424-2021 (O&M) Keeping in view the aforesaid facts, the petition is allowed. The proceedings of HMA-22/2021 (Jaideep Grewal vs. Amandeep Kaur), pending in the Court of Additional Civil Judge (Sr. Div.), Amloh, District Fatehgarh Sahib, are ordered to be transferred to the Court of competent jurisdiction at Ludhiana. The transferor Court is requested to remit the case file to the transferee Court forthwith. The parties are directed to appear before the District Judge, Ludhiana, on 01.10.2021 who shall either decide the matter himself or assign it to the Court of competent jurisdiction at Ludhiana.
All the pending miscellaneous applications, if any, are also disposed of.
