(ORAL) The petitioners have filed the present petition under Section 482 read with Section 483 Cr.P.C., seeking quashing of order dated 01.03.2024 (Annexure P-1) passed by the learned Judicial Magistrate Ist Class, Ludhiana, in case No. CHI/2344/2018 titled as 'State vs. Dhiraj Bhandari', whereby the application filed by the petitioner under Section 311 Cr.P.C. for recalling the material witness i.e. the complainant was dismissed. Further prayer has been made to grant one opportunity to cross-examine the complainant.
At the outset, learned counsel for the petitioner submits that she does not want to press this petition on merits, at this stage and confines her prayer only to the extent that the petitioners may be granted one effective opportunity to cross-examine the complainant, at their own responsibility.
