The present appeal pertains to the year 1995. Vide order dated 09.11.2023 notices were issued to the appellants as well as the sole respondent. As per the Office report, notice issued to appellant No.1 has been received back unserved with the report that the Office has been shifted. Appellant No.2 and the sole respondent stand duly served. Notice issued to appellant No.3 has been received back unserved with the report that the address is in Nuh and not in Gurgaon.

No one has appeared on behalf of appellant No.2 despite service. There is no other address available with the Court for effecting service of appellants No.1 and 3 except the one mentioned in the memo of parties and in the judgments and decrees passed by the Courts below and is the same on which the notices were sent.

In view thereof, this Court is left with no other option but to dismiss the present appeal for non-prosecution. AMAN JAIN 2024.03.18 21:27 I attest to the accuracy and integrity of this judgment/order.
