CORAM: HON'BLE MR. JUSTICE RAVI SHANKER JHA, CHIEF JUSTICE HON'BLE MR. JUSTICE ARUN PALLI
Present:
Mr. Akshay Bansal, Advocate, for the petitioners.
Ms. Tanisha Peshawaria, Deputy Advocate General, Haryana. Ms. Sehej Sandhawalia, Advocate, for respondents No. 3 and 4.
Mr. Arun Gosain, Senior Government Counsel, for respondents No. 5 and 6.
* * * * RAVI SHANKER JHA, C.J. (ORAL) The petitioners have filed this writ petition being aggrieved by the notification dated 14.02.2022 (Annexure P-1) issued by the respondentauthorities, whereby an amendment has been made in the eligibility criteria for admission to M.Sc. Nursing Courses for the academic session 2021-2022. After having withdrawn the previous writ petition being CWP-6467-2022 with liberty to approach the admission committee under clause (ix) and, if so required, the appellate authority thereafter under clause (x) of paragraph 9 of the notification dated 14.02.2022, the petitioners have filed the second writ petition for the same cause of action and relief. From the facts available on record, it is evident that the petitioners have not even invoked clause (ix) of paragraph 9 of the notification, though they had withdrawn the previous writ petition to do so and have now filed the second writ petition for the same cause of action and relief, which is not permissible in law.
In view of the aforesaid facts and circumstances, the writ petition is accordingly dismissed.
