The petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.14 dated 6.1.2017 registered for the offences under Sections 420, 336 and 315 IPC; Sections 18 (c) & 18-A of Drugs and Cosmetic Act, 1940 and Section 15(2) and 15(3) of Indian Medical Council Act, 1956 at Police Station Model Town Panipat, District Panipat.
I have heard learned counsel for the petitioner and have gone through the record.
From the record, I find that as per the FIR, a team comprising Dr. Munesh Kumar, H.D.O., Dr. Shalini Mehta, M.O., Sh. Parvinder Malik, DCO, was constituted by Civil Surgeon in connection with investigation of a complaint received from Dharamvir, which then raided the place. Cr. Misc. No.M-2287 of 2017 [2] Ram was found present and could not present his registration/licence for doing practice of allopathic medicines. On inspection by the team in the presence of the present petitioner, 25 different types of allopathic medicines and 3 different types of instruments for doing medical practice were found and they seized the same vide seizure memo.
Keeping in view the facts and circumstances of the present case, nature and gravity of the offences, I do not find it a fit case where the present petitioner is entitled to the benefit of anticipatory bail. Therefore, finding no merit in this petition, the same is dismissed.
