(Oral) Prayer in the present petition under Section 482 Cr.P.C. is for taking appropriate action in FIR No. 299 dated 28.12.2023 (Annexure P-5) under Sections 10, 12 of POCSO Act, 2012 registered at Police Station Sector 9 Ambala City District Ambala filed by the petitioner against respondent No.5-Sukhmandar Singh.

At the very outset, learned counsel for the State refers to the submissions made in para 12 of the status report dated 22.05.2024 filed by way of an affidavit of the Deputy Superintendent of Police, HQS, Ambala District Ambala on behalf of respondents No. 1 to 4 wherein it is stated as under:- "12. That on the same day, i.e. on dated 20.01.2024, SHO Police Station Sector 9, Ambala City also verified the facts of present case and finds that no case is made out against the Respondent no.5 and the allegations levelled by the complainant/petitioner against him were not proved on the case file, hence, on dated 28.01.2024, the Cancellation DIVYANSHI 2024.11.12 15:57 I attest to the accuracy and integrity of this document

CRM-M-20593-2024 (O&M) - 2Report has been prepared in the present matter and would be submitted before the Ld. Court of Illaqua Magistrate after approval of higher police officials."

In view of the same, learned proxy counsel for the petitioner submits that the present petition may be disposed of with liberty to the petitioner to take recourse to the appropriate remedy, as per law. Ordered accordingly.
