Notice of the application.

Mr. B.S. Sewak, Addl.AG, Punjab accepts notice on behalf of respondent-State of Punjab.

For the reasons recorded in the application, which is supported by an affidavit, the same is allowed and the matter is taken on board today itself.

Main case Prayer is for grant of regular bail in case FIR No.179 dated 30.12.2020 under Sections 22 & 29 of NDPS Act registered at P.S City-I, Malerkotla, District Sangrur.

Allegations against the petitioner are that 1000 tablets containing Tramadol Hydrochloride were recovered from him. As per FSL report, the weight of recovered contraband is 336 grams. Crl.M.No.20726 of 2022 in/and #2# CRM-M-16441 of 2021 been planted on the petitioner. Investigation in this case is already complete and that the petitioner is in custody since 30.12.2020. Trial of the case has not made any headway and that no other criminal case is registered against the petitioner.

Without commenting anything on the merits of the case and also bearing in mind the fact that the trial is not likely to be concluded in near future, in my opinion, no useful purpose will be served by detaining the petitioner behind bars any further. The petition, as such, is allowed. The petitioner Mohd Aarif is ordered to be released on bail on his furnishing bail bonds/surety bonds to the satisfaction of learned trial Court/Duty Magistrate concerned.
