(Oral) The appellant has filed the instant appeal against the judgment and decree dated 11.10.1989, passed by the learned trial Court whereby the suit for declaration filed by the plaintiff/respondent has been dismissed and the judgment and decree dated 12.12.1994, passed by the learned Appellate Court whereby the appeal preferred by the respondent/appellant against the aforesaid judgment and decree dated 11.10.1989, has been allowed.

Learned counsel for the State, on instructions from Ms. Gurpreet Kaur, SDE Samana, submits that during the pendency of the present appeal, the respondent has already retired as Assistant Engineer, on attaining the age of superannuation on 31.10.2006 and unfortunately, he has died. He further submits that all the retiral dues including the benefits arising out of the judgments passed by the Courts below have been released, therefore, nothing survives in the present appeal and the same may be disposed of.

Disposed of accordingly.
