NARESH KUMAR SANGHI, J.(ORAL) Both the parties, i.e. the petitioner as well as the Assistant Commissioner of Police (Central), Ludhiana/ Investigating Officer of the present case have filed their respective affidavits controverting the stand of each other regarding joining of the investigation by the petitioner. CRM-M-22866-2015 -2District Ludhiana, has pointed out that the informant/complainant has approached the Investigating Agency with the averment that he has resolved his dispute and effected a compromise with the petitioner. Therefore, without going into the controversy of joining the investigation by the petitioner, he (petitioner) be directed to join the investigation after making the interim directions absolute.
In view of the stand taken by the learned counsel for the State and going through the material available on record but without adverting to the controversies raised by both the parties by way of their respective affidavits regarding joining of the investigation by the petitioner, the present petition is allowed. Ad-interim directions issued vide order dated 16.07.2015 are made absolute. The petitioner shall continue to join the investigation as and when required to do so and abide by all the conditions laid down under Section 438(2), Cr.P.C.
