The petitioners who have been summoned with the aid of Section 319 Cr.P.C. by the trial Court vide order dated 18.2.2022 in a case arising out of FIR No. 39 dated 23.3.2019 under Sections 420, 465, 468, 471, 120- B of Indian Penal Code (Section 419 IPC added later on), Police Station Jaitu, District Faridkot seek grant of anticipatory bail.

Notice of motion had been issued.

The petitioners have already appeared before the trial Court and have been released on interim bail, as would be evident from order dated 24.5.2022 passed by learned SDJM, Jaitu, a copy whereof has been furnished by learned counsel for the petitioners, which is taken on record. Having regard to the fact that the petitioners have been summoned with the aid of Section 319 Cr.P.C. it necessarily follows that their custodial interrogation would not be warranted at this stage. 5.
The petition, as such, is accepted and the bail as granted by the trial Court vide order dated 24.5.2022 is made absolute.

It shall be open to the trial Court to impose any other condition upon the petitioners, as deemed appropriate, so as to ensure their regular presence before the trial Court.
