On 06.11.2024 the following order was passed : "Present appeal pertains to the year 1995. Since 2017 the matter is being listed for hearing and repeatedly on one ground or the other adjournments are being sought. The present counsel for the appellants had filed his vakalatnama on 20.01.2023 and even thereafter, on every date, request for an adjournment has been made. As far back as on 27.02.2023 final opportunity to argue the matter was given to learned counsel for the appellants. Despite that, repeatedly requests for adjournments are being made in the present case. Today again a written request for an adjournment has been circulated by learned counsel for the appellant on the ground that he wants to file an application for evicting certain encroachers. It is made clear that no further adjournment shall be granted on any account and in the event of the case not being argued on the next date of hearing, the same shall be deemed to have been dismissed for nonprosecution without the requirement of any further order."

Today, no one has put in appearance on behalf of the appellants despite the matter being called twice since morning. In view of the above, this Court is left with no other option but to dismiss the present appeal for non-prosecution.
