Applicant-wife has filed the present application for seeking transfer of the petition under Section 13 of the Hindu Marriage Act, filed by respondent-husband, bearing No.DMC-86-2025, titled 'Baljinder Singh vs. Paramjit Kaur', pending in the Family Court Bathinda, and she seeks transfer of the same to the Court of competent jurisdiction at Amritsar. Counsel for the applicant heard.
At the very outset, it is submitted that marriage between the parties to the lis, had taken place on 02.12.2018 and one daughter born from the said wedlock, who is about 5 years old, is in the care and custody of the applicant. TA-297-2025 -2residing separate. The applicant has filed petition under Section 12 of the Protection of Women from Domestic Violence Act and the same is still at appearance stage. The applicant has no source of earning and she is dependent upon her parental family.
Considering the constrained circumstances as submitted aforesaid and more particularly, while applicant herself not having any source of earning, is taking care of minor child and also considering the distance between the two places to be 200 kms. and above it, considering the fact of respondent not having come forward to resist the present application, the transfer application, as such, is hereby allowed and the petition under Section 13 of the Hindu Marriage Act, filed by respondenthusband, bearing No.DMC-86-2025, titled 'Baljinder Singh vs. Paramjit Kaur', stands transferred from the Family Court, Bathinda, to the Court of competent jurisdiction at Amritsar. The requisite record of the aforesaid case be sent by the Family Court, Bathinda, to the District and Sessions Judge, Amritsar.
Learned District and Sessions Judge, Amritsar, shall assign the said petition to the Family Court, Amritsar. Even, the parties are directed to appear before the Family Court, Amritsar, within a period of one month from today onwards.
