Dated Police Station Sections 21.06.2017 Jodhan, District 353, 186, 294, 506, 149 IPC and Ludhiana Sections 3, 4(i) of Scheduled Castes and Scheduled Tribes Act 1989 (Prevention of Atrocities) Act 1.

Aggrieved by the high handedness, false implication, arbitrary registration of FIR, petitioner had come up before this Court by filing the present quashing petition under Section 482 CrPC, way back in 2017.

Perusal of the file shows that petitioner's counsel did not try to delay the trial but unfortunately, matter was never taken up before this Court for final hearing and there was no stay on proceedings.

Considering the fact that the petitioner may be not even be involved and had to come before this Court, the present petition remained on pending for seven years, there is no reason to disbelieve or prima facie deny the allegations made by the petitioner in the present petition. However, It is for the reason that now the evidence has been concluded, this Court cannot proceed to quash the FIR. 5.

Be that as it may, petitioner is at liberty to raise all the points before the trial Court, in addition to the points which are raised before this court. Petitioner is also permitted to present their synopsis at the time of final hearing. 6.

Petition is disposed of in the terms mentioned above. Pending applications, if any, stand disposed of.
