SURINDER GUPTA, J. (Oral) Petitioners have filed this petition under Section 438 of Code of Criminal Procedure (for short 'Cr.P.C.') seeking anticipatory bail in case FIR No.54 dated 21.04.2011 registered at Police Station Kharar, District SAS Nagar for offences punishable under Sections 332, 333, 353, 186, 382, 307, 148 read with Section 149 of Indian Penal Code. Heard.

Learned counsel for petitioners submits that petitioners, namely, Amrik Singh and Gurpal Singh, are old persons, aged about 72 years and 61 years respectively. They were present in their house at the time of incident but no injury was attributed to them. They have joined the investigation on 01.09.2016 and after completion of investigation challan has been presented against them in Court in which they have not been arrayed as accused.

Learned State counsel on instructions from ASI Balbir Singh submits that police intends to file supplementary challan against Jitender Kumar 2016.12.13 16:53 I attest to the accuracy and integrity of this document

Keeping in view the above facts, the instant petition is allowed and order dated 27.08.2016 allowing interim bail to petitioners, is made absolute till filing of the supplementary challan subject to the terms as follows:- (i) That petitioners shall make themselves available for interrogation by investigating officer as and when required;

(ii) that petitioners shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer;

(iii) that petitioners shall not leave India without the prior permission of the Court.
