HARINDER SINGH SIDHU, J By means of this petition, petitioner seeks directions to official respondents to register an FIR against private respondents on the basis of his complaint (Annexure P.3) and conduct a fair and proper investigation. In M. Subramaniam & Anr Vrs. S. Janaki & Anr." reported in (2020) SCC Online SC 341, Hon'ble Supreme Court has held that if any person is aggrieved of non-registration of a case or the progress of investigation, an alternative remedy is available to him to approach the Magistrate in terms of Code of Criminal Procedure. Faced with the situation, learned counsel for the petitioner does not press this petition and wishes to withdraw the same with liberty to approach the concerned Magistrate for vindication of his grievance. Disposed of as having been withdrawn with the liberty aforesaid.
