Petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in complaint case No.78/2016 dated 16.06.2016 titled as 'Bank of Baroda vs. Rakesh Kumar and others' under Sections 406, 420, 466, 467, 468, 471 and 120-B IPC, in which the petitioner has been summoned to face trial under Sections 406, 420, 468 and 120-B IPC. Notice of motion was issued. Learned counsel for the respondent-Bank appeared and contested this petition. I have heard learned counsel for the parties and have gone through the record.
The perusal of the record shows that Bank of Barodarespondent has filed complaint against present petitioner along with other VINEET GULATI 2018.08.01 16:50 I attest to the accuracy and authenticity of this document Chandigarh

The present petitioner has been summoned in the complaint case. He is not required for investigation or custodial interrogation. He is only to face trial. In compliance of the order dated 31.05.2018, the petitioner has already appeared before the trial Court and has been released on interim bail and he is appearing regularly before the trial Court, as argued.
Keeping in view the facts and circumstances of the case and without discussing the facts of the case in minute details and without expressing any opinion on the merits of the case, I find it a fit case, where the petitioner is entitled to benefit of anticipatory bail. Therefore, the present petition is accepted and order dated 31.05.2018 granting interim bail to the petitioner is made absolute.
