******* SURINDER GUPTA, J.(Oral) Learned State counsel on instructions from ASI Sandeep Kumar submits that the petitioner was main conspirator and had hired Kabir and one more person, namely, Rahul son of Kewal to commit the crime. Charges have been framed against the petitioner but statement of complainant is yet to be recorded.

In view of submission of learned State counsel, learned counsel for the petitioner seeks permission to withdraw the petition with liberty to file fresh one after the statement of complainant is recorded.
