Through the instant writ petition, prayer is made for issuance of directions upon the respondent No.2 to decide the representation dated 01.02.2024 (Annexure P-3), and, to take action against the respondent No.5 on the basis of the order passed by the respondent No.3, and, on the basis of the inquiry report dated 01.12.2021.

Precisely, the grievance encapsulated in the present writ petition is that, the respondent No.5, without him being entitled to be the beneficiary of BPL Scheme, got prepared BPL card and reaped benefits thereof. Not only this, the respondent No.5 also acquired a 100 yards plot under the BPL Scheme.

Consequent upon issuance of notice upon the instant writ petition, a written statement dated 28.01.2025 was filed before this Court, on behalf of Mr. Manoj Kumar, HCS, Chief Executive Officer, Zila Parishad, DEVINDER YADAV 2025.04.03 17:06 I attest to the accuracy and authenticity of this order/judgment

CWP-6755-2024 Mahendergarh at Narnaul. Perusal of this written statement reveals that, the Chief Executive Officer had, on the basis of the apposite inquiry report, directed the B.D.P.O. concerned to take action against the respondent No.5, as he had acquired the gift deed of a 100 yards plot by illegal means from the Gram Panchayat Khudana. Subsequently, the Gram Panchayat also filed an application under Section 10-A of the Punjab Village Common Lands (Regulation) Act, 1961, for cancellation of the gift deed (supra), before the Court of Assistant Collector First Grade, Mahendergarh, which is pending adjudication. Not only this, the Deputy Director, Agriculture and Farmer Welfare Department, Narnaul, has also, after making assessment of the recovery amount, recovered an amount of ₹ 14,000/- from the wife of the respondent No.5. In the similar fashion, the District Food and Supplies Controller, Narnaul, has also recovered an amount of ₹ 46,790/- from the respondent No.5.

In view of the revelations made in the written statement (supra), since apt action has already been taken against the respondent No.5, hence the asked for direction is not required to be passed. Therefore, the instant writ petition is closed. However, direction is passed upon the Assistant Collector First Grade, Mahendergarh, to decide the application (supra) of the Gram Panchayat within four months after receipt of the certified copy of this order.
