The prayer in the present writ petition under Article 226 of the Constitution of India is for issuance of a writ in the nature of mandamus directing the respondents to promote the petitioner to the post of High School Headmaster with effect from the date the juniors of the petitioner have been promoted.

Learned counsel for the petitioner would contend that similarly situated persons had approached this Court and thereafter they have been granted promotion by the concerned authorities. Learned counsel for the petitioner would further submit that a legal notice dated 12.02.2021 (Annexure P-7) has also been sent to respondent No.2 in this regard, however, no action/decision has been taken qua the same. Learned counsel for the petitioner restricts his prayer and states that the petitioner would be satisfied if a direction is issued to respondent No.2 to take a decision on the legal notice dated 12.02.2021 (Annexure P-7) in a time bound manner. In view of the limited prayer made by learned counsel for the petitioner and without commenting on the merits of the case or the entitlement of the petitioner, the present petition is disposed off with a direction to respondent No.2 - Director, Secondary Education, Shiksha Sadan, Sector-5, Panchkula - to take a decision on the legal notice dated 12.02.2021 (Annexure P-7) expeditiously and in any case within a period of two months from the date of receipt of certified copy of this order.
