Learned counsel for the appellant submitted that he is not in touch with the appellant. In spite of repeated communications nobody has turned up so he is not in a position to file any application for impleading LRs of respondents No. 2 and 3. This is regular second appeal pending since 1995. So in the absence of impleading the LRs of respondents No. 2 and 3, the same cannot be proceeded further. It seems that appellant is not interested in pursuing the instant appeal. 2.

In view of the above and given the prevailing circumstances, there seems to be no justification to keep the appeal on the docket, indefinitely. Accordingly, the instant appeal stands dismissed for want of prosecution with liberty to the appellant to revive the same, if have any grievance from this order, within a period of three months from today.

Since the main appeal stands decided, the miscellaneous application(s), if any, stand disposed of accordingly.
