The petitioner prays for grant of pre-arrest bail in FIR No. 50 dated 19.02.2020, registered under Section 22 of the Narcotic Drugs & Psychotropic Substances Act, 1985 (Sections 27-A & 29 of the Act were added lateron) at Police Station Sadar Mansa, District Mansa. A connected petition, filed by the petitioner, i.e. Criminal Misc. No. M-14662 of 2020 arising from another FIR, has been dismissed by this Court vide separate order of even date.

In the present case, the police had recovered 13 vials of "ONEREX" intoxicating syrup, along with 130 tablets of "Carisoprodol" from Smt. Baljit Kaur. During the investigation, Smt. Baljit Kaur disclosed that the aforesaid contraband was supplied by the petitioner and they were to share the profit equally.

Criminal Misc. No. M-11870 of 2020 sought to be nominated as an accused on the statement of co-accused which is not admissible in evidence. He further submits that the petitioner has been falsely implicated in the present case.

On the other hand, learned counsel for the respondent/State has submitted that the petitioner is a drug paddler and habitual of indulging in illegal activities.

On consideration of the matter, this Court is not inclined to grant the concession of pre-arrest bail to the petitioner, keeping in view the order passed by this Court in the connected petition i.e. Criminal Misc. No. M-14662 of 2020 as well as the fact that in the present case, custodial interrogation of the petitioner shall be required as submitted by the Deputy Superintendent of Police in his reply.

Dismissed.
