******* SURINDER GUPTA, J.(Oral) Present petition has been filed under Section 438 Code of Criminal Procedure for grant of anticipatory bail to petitioners in case FIR No. 40 dated 17.07.2016 registered for offences punishable under Sections 326, 506 read with Section 34 of Indian Penal Code (for short 'IPC'), at Police Station Verowal, District Tarn Taran.

Heard.

Learned State counsel submits that petitioner no. 1-Gurmej Singh has joined the investigation and his custodial interrogation is no more required.

In view of submission of learned State counsel but without expressing any opinion on merits of the case, this petition is allowed and order dated 24.01.2017 is made absolute till the presentation of challan, subject to the following terms:- (i) that the petitioner shall make himself available for interrogation by the police as and when required; (ii) that the petitioner shall not, directly or indirectly, make Jitender Kumar 2017.03.30 10:00 I attest to the accuracy and integrity of this document CHANDIGARH

CRM-M-2305 of 2017 -2any inducement, threat or promise to any person acquainted with the facts of the accusation against him so as to dissuade him from disclosing such facts to the Court or to any police officer;

(iii) that the petitioner shall not leave India without the prior permission of the Court.

(iv) that the petitioner will seek regular bail on the presentation of challan in Court.

Learned counsel for petitioners submits that petitioner no. 2Ajit Singh was attributed sua blow on left elbow of the complainant, which was found simple in nature and was also not on vital part of the body. Keeping in view the nature of injury attributed to petitioner no. 2-Ajit Singh, his application seeking anticipatory bail is also allowed. He is directed to surrender before the police and join investigation within a week. In the event of his arrest being required, he shall be released on anticipatory bail, subject to his furnishing bonds to the satisfaction of Arresting Officer, till presentation of challan, on the same terms as indicated above.
