The petitioner seeks the concession of regular bail in a case of recovery of 700 intoxicating tablets, which were found to contain Diphenoxylate salt. The recovery is marginally higher than the commercial quantity prescribed under the NDPS Act. The total weight of the diphenoxylate hydrochloride salt is 54 grams . The petitioner being a lady; having earlier been granted the concession of interim bail on account of the fact that she was on family way; she having not misused the liberty and not indulged in the similar activity, can be granted the concession of bail. The petition is allowed and the petitioner is ordered to be released on bail on her furnishing bail bonds/ surety bonds to the satisfaction of the trial court. The petitioner will not commit the similar offence, of which she is accused of, during pendency of the trial.
