Vide order dated 22.11.2023 notices were issued to the parties. As per the office report, appellant Nos.1 to 4, 6, 8(i), 8(iii), 8(iv), 8(v) and 9 are stated to have died. Appellant Nos.5, 7 and 8(ii) remain unserved as they are not found residing at the given address. This is the only address of appellant Nos.5, 7 and 8(ii) which was given in the memo of parties as well as in the judgments and decrees of both the Courts. No one has come forward to get themselves impleaded as legal representatives of appellant Nos.1 to 4, 6, 8(i), 8(iii), 8(iv), 8(v) and 9 nor any counsel has put in appearance on their behalf. In view thereof, this Court is left with no other option but to dismiss the present appeal for non-prosecution. 2.

Dismissed for non-prosecution with liberty to revive in case anything survives in the matter. Pending applications, if any, also stand disposed off.
