FIR bearing No.61 dated 08.06.2015 has been registered at Police Station Women Cell, Ludhiana against the petitioner for the offence punishable under Sections 406 and 498-A IPC at the behest of his wife. The petitioner had filed application under Section 438 Cr.P.C. before the Additional Sessions Judge, Ludhiana, where the Additional Public Prosecutor made statement under the instructions of the Investigating Officer that there was no reason to arrest the petitioneraccused in this case because he is complying with the notice and recovery had been effected.

As the custody of the petitioner is no more required by the police at this stage, this petition is disposed of with direction to the respondent-State to give 5 days prior notice to the petitioner in case his arrest is required in this case.
