Date of decision: 09.03.2026 Khajan Chand ......Petitioner

Versus

State of Punjab and Ors.

.....Respondents CORAM: HON'BLE MS. JUSTICE AARADHNA SAWHNEY

Present:

Ms. Satpreet Grewal Kapila, Advocate for the petitioner. AARADHNA SAWHNEY , J (ORAL) By virtue of present petition, the petitioner has prayed for issuance of appropriate directions to official respondents to initiate proceedings against the private respondents with regard to an incident that occurred on 09.01.2026, in which his both sons were assaulted by the private respondents. While mentioning the backdrop of the case, learned counsel for the petitioner contends that one of sons of the petitioner was married to one Arshdeep Kaur. Marriage ceremony was performed in a simple manner. Both son of the petitioner and said Arshdeep Kaur were known to each other. Prior to marriage, it came to their notice that Arshdeep Kaur was emotionally attached with some other person, namely Laddi-respondent No.10.

Family members requested her to desist from such immoral activities, but no heed was paid. Even a Panchayat was convened, which did not bring the desired result. The petitioner and both his sons started receiving continuous threats from the private respondents. Apprehending threat to their life and liberty, the petitioner and his family members penned down a complaint dated 07.01.2026 mentioning the entire facts therein. The said complaint was addressed to the Senior Superintendent of Police, Batala.

marked to I.C Women Cell, Sri Hargobindpur Sahib, Batala. It is further the contention of learned counsel that on 09.01.2026, the petitioner and his sons were assaulted by the private respondents. In the incident, both the boys received serious injuries and were admitted to Civil Hospital, Batala. A copy of the MLR of one of the sons of the petitioner, namely Rahul, has also been referred to by learned counsel.

Continuing further, learned counsel contends that, acting at the instance of the private respondents, the Investigating Officer completely twisted the entire facts and recorded FIR No. 12 dated 08.01.2026. This FIR was registered at the instance of Lakhwinder Singh- respondent No. 5. The grievance of the petitioner is that despite the fact that both the injured were admitted in the hospital and were under medical treatment, the IO acted in an extremely partisan manner by not recording their statements. Thus, the version of the petitioner and her family members did not properly come on record. It is in this backdrop that the present petition has been filed. The limited prayer made by learned counsel for the petitioner is for issuance of directions to the official respondents to decide the representation dated 06.02.2026 (Annexure P.5) submitted by the petitioner, at the earliest.

Notice of motion.

On the asking of the Court, Mr. Gautam Thapar, Sr. DAG, Punjab, accepts notice on behalf of the respondent-State and has no objection in deciding the complaint filed on behalf of the petitioner. Heard. Contents of the application perused.

Without commenting upon the merits of the case and in view of the limited prayer made by learned counsel for the petitioner, the present petition is disposed of with a direction to respondent No.2-SSP, Batala to decide the

representation dated 06.02.2026 (Annexure P.5) as expeditiously as possible, in accordance with law.
