(Oral) Petitioner seeks grant of regular bail under Section 439 Cr.P.C. in his 5th attempt in case bearing FIR No.409 dated 21.05.2019 under Sections 379-B and 506 IPC and under Sections 25/54/59 of Arms Act (Offence under Section 392 IPC deleted and 379-B IPC added) registered at Police Station Civil Lines, District Karnal.

There are allegations of snatching gold as well as silver jewellery, cash and mobile phone etc at a pistol point from the residential house of the complainant. CRM-M No. 14945 of 2022 -2with the help of clothes. The case property has been recovered on the demarcation of the petitioner.

Earlier, CRM-M No.12792 of 2020 was got dismissed as withdrawn on 03.06.2020. Thereafter, CRM-M No.40619 of 2020 was also got dismissed as withdrawn on 11.01.2021. In the meanwhile, CRM-M No.42454 of 2020 filed by co-accused Sarwan was also dismissed on 21.02.2021. CRM-M No.10986 of 2021 was dismissed on merits on 16.03.2021. Thereafter, CRM-M No.266335 of 2021 was also dismissed on 05.10.2021. Keeping in view the gravity of offence and the manner in which the incident has taken place, no ground is made out to grant regular bail to the petitioner. At this stage, learned counsel for the petitioner wishes to withdraw the present petition.
