Prayer in the present petition is for issuing directions to respondents No. 2 to 4 to take necessary legal action against private respondents.
Vide last order dated 21.03.2024, learned counsel for the State was directed to get instructions in the matter. Consequently, status report dated 10.07.2024 by way of an affidavit of the Deputy Superintendent of Police, Punhana on behalf of respondents No. 1 to 4 is filed in Court today and the same is taken on record. Learned counsel for the State has drawn attention of this Court to the submissions made in para 6 of the said status report, which reads as under:- "That it is also worthwhile to mention here that after receiving complaint of opposite party, a detailed verification was conducted by L/SI Vinita, Police Station Nagina. After that investigation was conducted by L/SI DIVYANSHI 2024.07.12 12:02 I attest to the accuracy and integrity of this document
CRM-M-14848-2024 -2 - Rekha, Police Station Nagina and during the course of investigation, the aforesaid injured/witnesses have made their statement that the allegations mentioned in the complaint was made due to some misunderstanding and they do not want to pursue their complaint. The statements of injured persons of the first party are annexed as Annexure R-4 to 6."
Learned counsel for the respondent-State also refers to the statement of the complainant/victim/petitioner herein dated 18.06.2024 attached as Annexure R-4 with the status report, wherein it has been stated as under:- "It is stated that I am resident of aforesaid address. I have come to the house of my Fuffi Barfina w/o Arshad at her house in Firojpur Jhirka Dahar. There was a petty dispute our children with the children of Mustkeem s/o Allhabax and Sahib s/o Zaid Khan and we have moved a complaint in the police station. I do not know that in the complaint it was mentioned that I have been molested. I was not molested there was a dispute b/w the children. We have compromised the matter in the brotherhood. We do not want any action on our complaint. I have got recorded my statement heard, which is correct." In view of the above, no further direction is required to be issued in the matter and the present petition stands disposed of.
