M.M.S. BEDI, J. (ORAL) Petitioner while working as Accounts Clerk prepared the cheques which were issued to the Contractors who had not performed the work as per the specifications. The main accused have been granted the concession of pre-arrest bail on their depositing alleged excess amount received by them without prejudice to their rights. The co-accused of the petitioner i.e., the Executive Officer, has also been granted the concession of prearrest bail. The petitioner has already joined investigation. In view of said circumstances, the petition is allowed. It is ordered that in case of arrest of the petitioner, he shall be released on bail to the satisfaction of the arresting officer subject to the conditions that he will join investigation as and when required and will not tamper with the evidence or hamper investigation, in any manner.
