**** ANITA CHAUDHRY, J(ORAL) The petitioner is seeking regular bail in FIR No. 103 dated 6.10.2015 registered at Police Station Sadar Nabha under Sections 306, 34 IPC.

Counsel for the petitioner states that he has placed on record the zimni orders and the petitioner is in custody since 9.10.20215 and only one witness has been examined. He states that the private witnesses did not appear on 28.7.2016 and warrants were issued and on the next date PW Reeta Ram came late and was bound down but on the adjourned hearing, they again came late to the Court. The trial Court had also noted that the accused was being produced in the Court late as he was lodged in Nabha jail.

A perusal of the zimni order dated 28.7.2016 shows that Reeta Ram failed to appear, though, he had been bound down and now warrants of arrest have been issued and the trial is being delayed. Crl. Misc. No. M-24031 of 2016 -2Without commenting anything on the merits of the case and considering the fact that the trial will take time to conclude, the petition is allowed and the petitioner is ordered to be released on bail on his furnishing local surety and adequate bonds to the satisfaction of the trial Court/Duty Magistrate.
