Petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.77 dated 16.02.2018 under Section 392 IPC, registered at Police Station Ratia, District Fatehabad. Notice of motion was issued. Learned State counsel appeared and contested the petition.

I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. From the record, I find that, complainant Jagdish Kumar got recorded the FIR by stating that on 16.02.2018 at about 7.40 p.m., when he was going on his motorcycle bearing No. HR-59B-3806, after closing his shop, then four persons on two motorcycles attacked him with dandas and Vineet Gulati 2018.07.19 14:18 I attest to the accuracy and authenticity of this document Chandigarh

CRM No.M-24098 of 2018 -2forcibly took away his wallet containing Driving Licence, Registration Certificate, `280/- and a mobile phone make OPPO. Other accused have been apprehended and present petitioner has been nominated on the statement of co-accused.

As per learned State counsel, there are two other FIRs against the present petitioner for similar offence.

Keeping in view the facts and circumstances of the present case, serious allegations against the petitioner in the FIR, I find that petitioner is required for custodial interrogation and no ground is made out to grant anticipatory bail to the petitioner. Therefore, finding no merit in the present petition, the same is dismissed.

However, nothing stated above, shall constitute my opinion on merits of the case.
