 Prayer in the present petition under Article 226 of the Constitution read with Section 3(1)(a) of the Haryana Good Conduct Prisoners (Temporary Release) Act, 1988, is for grant of emergency parole of four weeks to the petitioner to attend the marriage of his real niece, namely, Shalu Sharma (daughter of his real brother), which is to be solemnized on 21.04.2022.

Short reply by way of an affidavit dated 18.04.2022 of the Deputy Superintendent Central Jail, Ambala, filed on behalf of the respondent-State, in the Court, is taken on record. Learned counsel for the petitioner submits that the petitioner was convicted and sentenced to undergo life imprisonment by the learned Sessions Judge, Yamuna Nagar, in FIR No.61 dated 23.06.2006, registered under Sections 302 and 392 IPC, at Police Station Khizrabad, Yamuna Nagar, Haryana; that the appeal preferred by the petitioner AMAN JAIN 2022.04.19 18:06 I attest to the accuracy and authenticity of this document

CRWP-3225-2022(O&M) -2against the said judgment of conviction and order of sentence was dismissed on 19.02.2013; that the petitioner has been in custody for the last more than 16 years and that the real brother of the petitioner has already left the house long back. He further submits that the petitioner being the eldest and only male member in the family (real paternal uncle) is to perform the rituals in the marriage of his niece-Shalu, which is to be solemnized on 21.04.2022.

The factum of marriage stands verified on the basis of the report received from the SHO Police Station Devband, District Saharanpur and the Gram Panchayat Dandhera Block Naggal dated 15.04.2022, as would appear from the reply submitted by the Deputy Superintendent Central Jail, Ambala.

I have heard the learned counsel for the parties. As the petitioner is required to perform rituals in the marriage of his niece and statedly, he is the only male member in the family, the present petition is allowed and the petitioner is ordered to be released on emergency parole from 20.04.2022 till 25.04.2022. The petitioner shall surrender before the jail authorities immediately after the expiry of the emergency parole period.
