**** RITU BAHRI, J. (Oral) Prayer in this petition is for grant of anticipatory bail to the petitioner, in a case arising out of FIR No.138 dated 22.07.2016, registered at Women Police Station, Sector 51, Gurgaon, who has been booked for having committed the offences punishable under Sections 406 and 498-A read with Section 34 IPC.

Vide order dated 25.01.2017, the petitioner has been granted the benefit of interim bail to enable him to join the investigation and to solve the matter amicably.

Learned counsel for the petitioner submits that with the assistance of Mr. Swarn Sandhir, Mediator, the matter has been Naresh Kumar 2017.03.31 15:59 I attest to the accuracy and integrity of this document Chandigarh

CRM-M-2316-2017 -2compromised between the parties, vide settlement/compromise agreement dated 29.03.2017.

As per condition No.1 of the said compromise, first installment of `20,00,000/- will be paid by the petitioner to respondent No.2 on or before 21.04.2017.

In view of the totality of the facts and circumstances of the case, order dated 25.01.2017, passed by this Court whereby the ad-interim anticipatory bail was granted to the petitioner is made absolute, subject to compliance of terms and conditions of settlement dated 29.03.2017. The petitioner shall continue to join the investigation as and when required to do so and abide by all the conditions as envisaged under Section 438 (2) Cr.P.C.

Further, litigation expenses of `35,000/- deposited by the petitioner with the Registry of this Court be released to complainantrespondent No.2 forthwith. Accordingly, the present petition stands disposed of. CRM-8794-2017 Since the main petition for pre-arrest bail filed by the petitioner was made absolute, the present application is hereby allowed and the petitioner is granted permission to go to Mauritius on 02.04.2017, subject to condition that he will come back to India and comply with the terms and conditions of settlement dated 29.03.2017.
