Petitioners have filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.47 dated 21.05.2017 under Sections 324, 323, 341, 148 and 149 IPC (Section 326 IPC added later on), registered at Police Station Sekhwan, Police District Batala, District Gurdaspur.

As per order dated 06.07.2017, the present petition qua petitioner Satinder Singh has already been dismissed as withdrawn. Notice of motion was issued. Learned State counsel appeared and contested the petition.

CRM No.M-23160 of 2017 -2From the record, I find that the present petitioner Gurnam Singh is stated to be armed with datar and he has given grievous injury on the left hand's little finger of the complainant. Petitioner Gurnam Singh has already joined the investigation. He is not required for custodial interrogation. The trial of the case will take long time. No useful purpose will be served by sending the petitioner to custody.

Keeping in view the facts and circumstances of the case and without discussing the facts of the case in minute details and without expressing any opinion on the merits of the case, I find it a fit case, where the petitioner is entitled to benefit of grant of anticipatory bail. Therefore, the present petition is accepted and the order dated 06.07.2017 granting interim bail to petitioner Gurnam Singh, is made absolute.
