R.P. NAGRATH, J. (ORAL) This petition under Section 438 Cr.P.C. has been filed by the petitioner seeking anticipatory bail in FIR No. 76 dated 19.05.2013 registered under Sections 323/324/452/148/149 of the Indian Penal Code at Police Station Sadar, District Hoshiarpur. When this case was listed on 27.01.2015, following order was passed:- "Learned counsel for the petitioner has submitted that simple injury has been attributed to the petitioner and the main accused has been allowed the concession of bail vide order dated 24.02.2014 passed in CRM No. M-41057 of 2013.

CRM-M-2313-2015 -2In the meantime, in the event of arrest, the petitioner is ordered to be released on interim bail, on his furnishing bail bonds to the satisfaction of SHO/Investigating Officer subject to the conditions envisaged under Section 438 (2) Cr.P.C and on joining investigation."

On instructions from HC Naresh Kumar, learned State counsel submits that petitioner has joined the investigation and he is no more required for further interrogation.

The petitioner was attributed injury on the right hand of Birbal with a rod for attracting offence under Section 323 IPC. The main accused, namely; Baljinder Singh who has been attributed injury on the head for attracting offence under Section 324 IPC has already been granted the concession of pre-arrest bail by this Court vide order dated 24.02.2014 (Annexure P-5) passed in CRM-M-4105-2013. In view of the above and without expressing any opinion on merits of the case, the instant petition is allowed and the interim bail granted to the petitioner vide order dated 27.01.2015 is made absolute and the petitioner shall abide by the conditions as enshrined in Section 438 (2) Cr.P.C.
